Rules for buying and selling goods in the fitsport.lt online store

1. Concepts

1.1. Seller - UAB "Aivaro sportas" UAB "Aivaro sportas", legal entity registered in the Kaunas branch of the Republic of Lithuania VĮ "Registrų centras", VAT payer code LT100009207214, registration address Aitvarų st. 14, Gindulių k., LT-91276 Klaipėdos r. .

1.2. Fitsport.lt - electronic store located at www.fitsport.lt.

1.3. The buyer - 1) an able-bodied natural person, that is, a person who has reached the age of majority, whose capacity is not limited by court order; 2) a minor between fourteen and eighteen years of age who has the consent of his parents or guardians, except in cases where he is emancipated; 3) legal entity; 4) duly authorized representatives of all the above-mentioned persons.

1.4. Personal data - Buyer's name, delivery address, phone number, e-mail address.

1.5. Rules - these are the rules for buying and selling goods in the online store www.fitsport.lt. 1.6. Account - the result of the buyer's registration on the fitsport.lt website, which stores the buyer's personal data and order history.

2. General provisions

2.1. After the Buyer approves the Rules (after familiarizing himself with the Rules and ticking the box next to the statement "I have read and agree to the Purchase Rules"), it is a binding legal document for the parties, which sets out the rights and obligations of the Buyer and the Seller, the conditions for purchasing and paying for the goods, the delivery of the goods and return procedure, responsibility of the parties and other conditions related to the purchase and sale of goods in the fitsport.lt electronic store.

2.2. The Seller has the right to change, amend or supplement the Rules at any time. The new version of the Rules enters into force after its publication on the website www.fitsport.lt. Only Buyers, as defined in Clause 1.3 of the Rules, have the right to buy in the electronic store fitsport.lt. By approving the Rules, the buyer confirms that he has the right to buy goods in the electronic store fitsport.lt.

3. Protection of personal data

3.1. I agree that my name, surname, e-mail and phone number will be processed by fitsport.lt for the purposes of performance analysis and direct marketing.

3.2. The buyer has the following rights:

3.2.1. to know (be informed) about the processing of your Personal Data;

3.2.2. get acquainted with your Personal data and how they are processed;

3.2.3. demand correction, destruction of your Personal data or suspension of Personal data processing actions, when the data is processed in violation of the provisions of the Law on Legal Protection of Personal Data and other laws, except for the cases provided for in the Rules.

3.3. The Buyer agrees in advance that the Seller has the right to keep his data on the server indefinitely, if the data provided by the Buyer was (i) used in the commission of an illegal act or (ii) it was suspected that identity theft or other violation had been committed, as a result of which the relevant law enforcement agencies were or will be investigation by institutions, (iii) if the Seller has received complaints related to the relevant Buyer, or if the Seller has noticed violations of the Rules committed by the relevant Buyer, or (iv) if there are other legitimate purposes for storing Personal Data.

3.4. Pursuant to clauses 10.2.2 and 10.3.3 of the Regulations, the Buyer's identity document is presented to the Seller, AB Lietuvos paštas, UAB Baltic Post employee, UAB Venipak Lietuva employee or employee of another courier service for perusal and the Buyer's data contained therein is used only for proper identification.

3.5. In order to provide the Buyer with full-fledged fitsport.lt electronic store services, the Seller records information - cookies - on the Buyer's computer (device). The Seller uses the recorded information to identify the Buyer as a previous visitor of the fitsport.lt online store, to save information about purchases placed in the Buyer's shopping cart, and to collect fitsport.lt electronic store attendance statistics. The Buyer has the opportunity to review what information (cookies) the Seller records and can delete part or all of the recorded cookies. The buyer also has the right not to consent to the recording and use of information (cookies) on his computer (device), but in this case certain functions of the fitsport.lt online store may not be available to him. 3.6. 4. Ordering goods, the moment of creation of legal relations of purchase and sale

4.1. The buyer can order goods in the electronic store fitsport.lt by registering on the website www.fitsport.lt (by entering his registration name and password) or by shopping as a guest (ie without creating his own account).

4.2. When ordering goods, the buyer must specify his personal data necessary for the proper execution of the goods order in the relevant information fields provided by the Seller: name, surname, delivery address, telephone number and e-mail address. The buyer agrees to send informational messages to the e-mail address and phone number provided by him, which are necessary to fulfill the order for goods. The Buyer also agrees that the Buyer's Personal Data or part thereof will be transferred to the Seller's partners in order to properly fulfill the order and/or properly provide the ordered services.

4.3. From the moment when the Buyer, after choosing the item(s) to be purchased and creating a shopping cart, clicks on the "Confirm order" link, it is considered that a legal purchase-sale relationship has arisen between the Seller and the Buyer. 4.4. Each order of the Buyer is stored in the database of the electronic store fitsport.lt.

5. Buyer's rights

5.1. The buyer has the right to buy goods and order services in the electronic store fitsport.lt in accordance with the procedure established by these Rules. After ordering services, the terms and conditions of service provided by the Seller's partners may be applied to the Buyer.

5.2. The buyer has the right to refuse the order in accordance with the procedure established by these Rules.

5.3. The buyer has the right to return the purchased goods in accordance with the procedure established by the Rules.

5.4. The buyer has other rights established in these Rules.

6. Obligations of the buyer

6.1. The buyer, using the electronic store fitsport.lt, undertakes to comply with these Rules, other conditions clearly indicated in the online store, and not to violate the laws of the Republic of Lithuania.

6.2. After registering on the website www.fitsport.lt, the Buyer undertakes to ensure that the provided information and Personal Data are not misleading or incorrect.

6.3. If the Personal data provided in the registration form of the registered Buyer changes, the Buyer must update them immediately.

6.4. The Buyer undertakes to protect the login data to his Account, not to transfer them to third parties and not to enable third parties to find out the Buyer's login data. The Buyer understands that he is directly responsible for losses caused by the unauthorized use of the Buyer's Account, when the Buyer did not protect his login data and they became known and/or accessible to third parties.

6.5. If the Buyer's login data becomes known to third parties, the Buyer must immediately inform the Seller about this within one working day.

6.6. When the login data to the Buyer's account became known to third parties, the Seller deletes such account and gives the Buyer the right to create a new Account.

6.7. The buyer must pay for the ordered goods and accept them in accordance with the procedure established by these Rules.

7. Seller's Rights

7.1. The seller has the right to change or suspend the functions of the website www.fitsport.lt, the layout of the elements on the website, to stop the operation of certain website functions.

7.2. The seller has the right to suspend or terminate the activity of the fitsport.lt online store.

7.3. The seller has the right to change the scope or method of providing the services provided in the electronic store fitsport.lt, to suspend or terminate the provision of services or part of them, to charge for services or part of services.

7.4. The Seller has the right to determine and change the minimum size of the basket of goods at its discretion, that is, the minimum amount, upon reaching which the Buyer's order will be executed. The size of this amount is visible when viewing the shopping cart.

7.5. If the Buyer tries to damage the website www. fitsport.lt work stability and security or does not fulfill its obligations, the Seller has the right to immediately and without prior warning limit or suspend the Buyer's ability to use the website www.fitsport.lt or, in exceptional cases, cancel the Buyer's Account.

7.6. The Seller has the right to cancel the Buyer's order without prior notice, if the Buyer, having chosen the payment method provided for in Clause 9.2.1 of the Rules, does not pay for the goods within 3 (three) working days.

7.7. When the Buyer chooses the payment method provided for in Clause 9.2.2 of the Rules - in cash at the time of delivery of the goods, the Seller, in the event of uncertainty regarding the information provided in the order, has the right to contact the Buyer at the e-mail address or phone number specified in the order. In this case, the term of delivery of the goods starts counting from the day of contact with the Buyer. The Seller has the right to cancel the Buyer's order without prior notice if the Seller fails to contact the Buyer within 3 (three) business days after the order was placed.

8. Obligations of the seller

8.1. The Seller undertakes to enable the Buyer to use the services provided by the electronic store fitsport.lt under the conditions set out in these Rules and the online store.

8.2. The Seller undertakes to respect the Buyer's privacy right to personal information belonging to him, that is, to process the Buyer's Personal Data only in accordance with Chapter 3 of the Rules and the procedure established by the legal acts of the Republic of Lithuania.

8.3. Inform the Buyer about the changes specified in clauses 7.1 - 7.4 of the Rules.

8.4. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer under the conditions specified in Chapter 10 of the Rules.

8.5. The Seller undertakes to accept the goods returned by the Buyer under the conditions specified in Chapter 12 of the Rules.

8.6. If, due to important circumstances, the Seller is unable to deliver the ordered product to the Buyer, he undertakes to offer the Buyer an analogous or similar product as far as possible. If the Buyer refuses to accept the product, which was offered as analogous or similar, the Seller undertakes to return the money paid to the Buyer within 10 (ten) working days, if prepayment was made, and in all cases to cancel the order.

9. Product prices, payment procedure and terms

9.1. The prices of goods in the fitsport.lt electronic store and in the formed order are indicated in euros, including the amount of VAT valid at that time according to the legislation.

9.2. The Buyer can pay for the ordered goods in one of the following ways:

9.2.1. using electronic banking;

9.2.2. in cash at the time of delivery/collection of goods. This service is only available if delivery by courier to home or workplace is selected. The service fee is EUR 0.95.

9.3. When the Seller receives payment for the goods or when the order is completed (if the Buyer has chosen the payment method specified in Clause 9.2.2 of the Rules), the goods parcel begins to be formed and the goods delivery deadline begins to be calculated.

10. Delivery of goods

10.1. When ordering goods, the Buyer can choose one of the methods of delivery of the goods, specified in clauses 10.2 - 10.4 of the Rules. Terms and prices of goods delivery are available at http://fitsport.lt/prekiu-apmokejimas-ir-pristatymas. Clicking the "Confirm order" button means that the buyer has familiarized himself with the delivery conditions and rates and agrees with them

10.2. If the Buyer chooses home or workplace delivery service during the order:

10.2.1. The buyer undertakes to indicate the exact place of delivery of the goods.

10.2.2. The buyer undertakes to accept the goods himself. When accepting goods, it is necessary to present a valid personal identification document (identity card, passport or new model driver's license). If the Buyer cannot accept the goods himself, and the goods are delivered to the address specified by the Buyer, the Buyer has no right to make claims to the Seller regarding the delivery of the goods to the wrong person.

10.2.3. The goods are delivered by the Seller or his authorized representative.

10.3. If the Buyer chooses delivery of goods by mail during the order:

10.3.1. The seller sends the goods by registered mail.

10.3.2. The Seller sends the number of the registered mail to the Buyer to the e-mail address that was provided during the order.

10.3.3. When picking up the goods at the post office, the buyer must present a valid personal identification document (identity card, passport or new model driver's license) to the post office employee.

10.4. If the Buyer chooses the delivery of the Goods to the LP Express terminal during the order:

10.4.1. The Buyer is informed about the delivery of the goods to the terminal via a short message to the phone number that was provided during the order.

10.4.2. Goods weighing less than 30 kg can be picked up at LP Express terminals. Goods heavier than 30 kg are not delivered to post machines.

10.4.3. The shipment must be collected from the LP Express terminal within 7 (seven) calendar days after receiving information about the delivery of the product.

10.5. The seller sends the goods to the buyer within 1-2 days after receiving the payment. This term is preliminary and does not apply in cases where the Seller does not have the required goods in stock and the Buyer is informed of the shortage of the goods ordered by him. By approving these Rules, the Buyer agrees that in exceptional cases the delivery of goods may be delayed. In this case, the Seller undertakes to immediately contact the Buyer and coordinate the delivery terms and other conditions.

10.6. In all cases, the Seller is released from responsibility for the violation of the deadlines for the delivery of the goods, if the goods are not delivered to the Buyer or are delivered late due to the fault of third parties or due to circumstances beyond the control of the Buyer.

10.7. During the delivery of the goods to the Buyer, the Buyer must together with the Seller or his authorized representative check the condition of the shipment and the goods(s) and sign the shipment transfer - acceptance document. After the buyer signs the shipment transfer - acceptance document, it is considered that the shipment is transferred in a suitable condition, there are no product damages, the origin of which cannot be attributed to a factory defect, and there are no discrepancies in the package of the product(s) (such as can be determined during the external inspection of the goods). Having noticed that the package of the delivered shipment is damaged (crumpled, wet or otherwise externally damaged), the product(s) is damaged and/or the product(s) is not properly assembled, the Buyer must note this in the shipment transfer - acceptance document and , in the presence of the Seller or his representative, to draw up a free-form act of violation/nonconformities of the shipment and/or product(s). If the Buyer does not perform these actions, the Seller is released from responsibility for damage to the goods, if the basis for the occurrence of such damage is not a factory defect and due to inconsistencies in the composition of the goods, and if these inconsistencies can be determined during an external inspection of the goods.

10.8. If, based on clauses 10.2 - 10.4 of the Rules, the Buyer does not pick up the goods within the specified period or fails to deliver them to the Buyer and the Buyer has paid for the goods, the representatives contact the Buyer regarding another time and/or method of delivery of the goods. If the Buyer still does not collect the goods or fails to deliver them, such goods are returned to the Seller, the order is cancelled, and the money paid for the goods is returned to the Buyer.

10.9. If, based on clauses 10.2 - 10.4 of the Rules, the Buyer does not pick up the goods within the specified period or fails to deliver them to the Buyer and the Buyer has not paid for the goods, such goods are returned to the Seller, and the order is cancelled.

11. Product quality guarantee and expiration date

11.1. The characteristics of each product sold on fitsport.lt are indicated in the product description attached to each product.

11.2. The seller is not responsible for the fact that the size, shape, color or other parameters of the goods in the online store may not correspond to the real size, shape, color or other parameters of the goods due to the characteristics of the display used by the Buyer or other technical reasons. The buyer is recommended to read the product description.

11.3. The seller provides a guarantee of the quality of the items valid for a certain period of time for different types of goods, the specific term and other conditions of which are indicated in the descriptions of such goods.

11.4. The quality guarantee provided by the seller does not limit or constrain the rights of consumers, which are established for them by legal acts after purchasing a product or service of inappropriate quality.

11.5. In cases where, on the basis of legal acts, a certain expiration date is determined for specific goods, the Seller undertakes to sell such goods to the Buyer in such a way that he is given a real opportunity to use such goods until the end of the expiration date.

12. Return and exchange of goods

12.1. In order to return goods purchased in the www.fitsport.lt online store, you need to know:

12.1.1. The buyer can return the purchased goods within 14 days without any specified reason, no matter how they were purchased: in a physical store or online store or by phone, the same rules still apply to you, the return will take place in accordance with (only when buying online) 6.228 of the Civil Code of the Republic of Lithuania (10 )

12.1.2. Regarding the return of goods, the Buyer must notify the Seller by e-mail. by mail to uzzakymai@fitsport.lt, the message must indicate the returned goods and the reason for the return within 14 days from the date of delivery of the goods

12.1.3. Replacement or refund of defective goods purchased both online and in a physical store: when the reason for the return of the goods is the wrong quality (eg: damaged packaging, expired goods, etc.) or you received the wrong product that you ordered, we undertake to replace the wrong ones at our own expense quality product with a good quality product, or refund the money you paid for the product and cover the shipping costs you incurred. Goods of unsuitable quality are exchanged or returned in accordance with the retail trade rules approved by the Resolution of the Government of the Republic of Lithuania on 11.06.2001 no. 697, point 18, it states that unsuitable goods are exchanged for suitable goods, exchanged or returned based on the cases and conditions established in Article 6.363 of the Civil Code.

12.1.4. Returns of goods of suitable quality

12.1.5. When buying online, goods are returned based on the cases and conditions established in Article 6.363 of the Civil Code.

12.1.6. When buying goods online, the goods must be returned to the address specified by the Seller in the e-mail sent to the Buyer confirming the return of the goods.

12.1.7. If the returned goods are sent to any other postal machine or to the Lithuanian post office, they will not reach us, because we do not have someone to run around and collect parcels from different places.

12.1.8. When buying in a physical store, the product can be returned or exchanged only by Government Resolution No. 11-06-2001. 697 in accordance with the approved Retail Trade Rules.

12.2.9. In both cases, the costs of returning the goods are paid by you, this applies only to goods of suitable quality, if for one or another reason known only to you, you think that you do not like the goods and want to return them. If you purchased the item in our physical store, you can bring it back to the store and get a refund. If the product is purchased remotely, you will receive the money back to your bank account within 1-7 working days. If the goods were purchased remotely, but you returned them in a physical store, the money for the goods will still be returned by bank transfer.

12.2. These conditions must be followed when returning goods

12.2.1. The returned item must be in its original, neat packaging (this clause applies even when returning a defective item, except for cases where a defective cosmetic or perfumery item is returned);

12.2.2. The product must be undamaged by the Buyer

12.2.3. The product must not have lost its commercial appearance (labels intact, protective film not torn off, etc.) (this clause applies in both cases, even when a defective product is returned)

12.2.4. The returned item must be in the same package as the one received by the Buyer

13. Liability

13.1. The buyer is fully responsible for the correctness of the personal data provided by him. If the Buyer provides incorrect or inaccurate personal data, the Seller is not responsible for the resulting consequences and acquires the right to demand compensation from the Buyer for direct losses incurred.

13.2. The buyer is responsible for the actions performed using the electronic store fitsport.lt.

13.3. After registering, the Buyer is responsible for storing and/or transferring his login data to third parties. If the services provided by fitsport.lt are used by a third person who has connected to the online store using the Buyer's login data, the Seller considers this person to be the Buyer.

13.4. The Seller is released from any responsibility in cases where losses arise because the Buyer, regardless of the Seller's recommendations and his obligations, did not familiarize himself with these Rules, although he was given such an opportunity.

13.5. If the Seller's electronic store fitsport.lt contains links to the websites of other third parties, the Seller does not guarantee that the information that can be viewed by clicking on these links is correct, complete or accurate. Third parties are responsible for the content, correctness, completeness and accuracy of information provided by third parties. The seller is not obliged to check the transmitted or stored external information or to detect illegal actions.

13.6. In the event of damage resulting from non-fulfillment of obligations or improper execution of the purchase order, the guilty party shall compensate the other party for direct losses incurred.

14. Exchange of information

14.1. The seller sends all messages according to 3.2 of the Rules. the procedure provided for in paragraph 1. to the e-mail address provided by the Buyer.

14.2. The Buyer sends all messages and questions using the means of communication specified in the "Contacts" section of the Seller's online store.

15. Final provisions

15.1. These rules are drawn up in accordance with the legal acts of the Republic of Lithuania.

15.2. Relations arising on the basis of these Rules shall be governed by the law of the Republic of Lithuania.

15.3. All disagreements arising from the implementation of these Rules shall be resolved through negotiations. If it is not possible to reach an agreement within 20 (twenty) calendar days, disputes are resolved in accordance with the procedure established by the legal acts of the Republic of Lithuania.
